These Terms of Service (“Terms”) govern all purchases, website usage, wholesale transactions, retail transactions, and interactions with:

By accessing these websites, purchasing products, submitting payment, creating an account, or engaging with Hill Country Hemp in any manner, you agree to these Terms.

If you do not agree, do not use these websites or purchase products.

1. ELIGIBILITY & AGE REQUIREMENT

You must be at least twenty-one (21) years old to access these websites or purchase any cannabinoid, hemp-derived, smokable, or ingestible product.

By placing an order, you represent and warrant that:

  • You are at least 21 years old
  • You have the legal authority to enter into this agreement
  • You are legally permitted to purchase products in your jurisdiction

We reserve the right to request identification or cancel orders at our discretion.

2. COMPANY STATUS

Hill Country Hemp operates as a hemp manufacturer, distributor, retailer, and wholesale supplier in accordance with applicable federal and Texas laws, including the 2018 Farm Bill and Texas hemp regulations.

Products sold may include hemp-derived cannabinoids including but not limited to:

  • Delta-8 THC
  • Hemp-derived Delta-9 THC
  • THC-A
  • CBD
  • Other federally compliant hemp-derived cannabinoids

Availability may vary by jurisdiction.

3. PRODUCT COMPLIANCE

All products are intended to comply with applicable federal and Texas hemp laws at the time of manufacture.

Customers are solely responsible for determining whether products are legal in their state, county, city, or jurisdiction before purchase.

Hill Country Hemp reserves the right to:

  • Refuse service
  • Cancel orders
  • Restrict shipments
  • Limit product availability

based on changing laws, regulations, or compliance concerns.

4. CERTIFICATES OF ANALYSIS (COAs)

Certificates of Analysis (“COAs”) may be available online or upon request.

COAs are intended solely for informational and compliance purposes.

Customers acknowledge that cannabinoid potency, terpene profiles, color, aroma, texture, and appearance may vary by batch.

5. NO MEDICAL CLAIMS

Products sold by Hill Country Hemp and Hemp-A-Rita are not intended to diagnose, treat, cure, or prevent any disease.

No statements made on these websites have been evaluated by the U.S. Food & Drug Administration (FDA).

Retailers, affiliates, influencers, distributors, and wholesale buyers are prohibited from making unauthorized medical, therapeutic, or health-related claims regarding products.

6. RESPONSIBLE USE

Certain products may produce intoxicating, psychoactive, relaxing, sedative, or mood-altering effects.

You agree that you will NOT:

  • Drive or operate machinery after use
  • Consume products irresponsibly
  • Provide products to minors
  • Resell products illegally
  • Misrepresent products to consumers

You assume all responsibility for product usage after delivery.

7. WHOLESALE TERMS

Wholesale Qualification

Wholesale pricing, tax exemptions, distributor accounts, and resale privileges may require:

  • Business verification
  • Resale certificates
  • Hemp licenses where applicable
  • Additional documentation upon request

Hill Country Hemp reserves the right to approve or deny wholesale accounts at its discretion.

Wholesale Customer Responsibilities

Wholesale buyers agree that they are solely responsible for:

  • Product resale compliance
  • Local licensing requirements
  • Retail compliance
  • Packaging compliance after repackaging
  • Marketing compliance
  • Product handling after delivery

Wholesale customers may not:

  • Alter COAs fraudulently
  • Make illegal claims
  • Repackage products unlawfully
  • Resell into prohibited states or jurisdictions

MAP, Pricing & Distribution

Hill Country Hemp reserves the right to:

  • Adjust pricing without notice
  • Limit wholesale territories
  • Refuse distributor relationships
  • Terminate wholesale accounts for policy violations

Wholesale customers may be subject to separate MAP, reseller, or distribution agreements.

8. RETAIL CUSTOMER TERMS

Retail purchases are intended for personal use unless otherwise authorized.

Customers agree:

  • Not to resell products illegally
  • Not to modify products for unlawful purposes
  • Not to misrepresent product legality or ingredients

Retail purchases may be limited in quantity based on inventory, compliance, or fraud prevention concerns.

9. PAYMENT TERMS

Payments are processed through third-party processors including but not limited to Square.

Orders may be delayed, reviewed, canceled, or refunded due to:

  • Fraud concerns
  • Payment verification issues
  • Compliance reviews
  • Inventory availability

Chargebacks, payment disputes, or fraudulent claims may result in:

  • Account termination
  • Legal action
  • Collection activity
  • Permanent refusal of future service

10. SHIPPING & DELIVERY

Shipping timelines are estimates only and are not guaranteed.

Hill Country Hemp is not liable for delays caused by:

  • Carriers
  • Weather
  • Supply chain interruptions
  • Government actions
  • Compliance reviews
  • Force majeure events

Risk of loss transfers to the customer once orders are transferred to the shipping carrier.

11. RETURNS & REFUNDS

All returns, refunds, exchanges, machine sales, consumable product policies, flower policies, and restocking fees are governed by the official:

12. FLOWER & SMOKABLE PRODUCTS

All flower, pre-rolls, smokable hemp products, and THC-A flower sales are FINAL.

No returns, refunds, exchanges, or cancellations will be accepted unless required by law.

13. MACHINE BUNDLES & PROMOTIONAL OFFERS

Machine bundle promotions may include:

  • Gift cards
  • Equipment credits
  • Promotional reimbursements
  • Branding incentives
  • Product bundles

These promotional items:

  • Have no cash value
  • Are non-refundable
  • Cannot be redeemed for cash
  • Do not qualify associated products for return if unused

All machine bundle sales are final unless otherwise required by law.

14. INTELLECTUAL PROPERTY

All logos, branding, graphics, packaging, product names, text, images, videos, website content, and trademarks are the property of Hill Country Hemp unless otherwise stated.

Unauthorized use, reproduction, distribution, or modification is prohibited.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Hill Country Hemp, Hemp-A-Rita, affiliates, owners, employees, contractors, distributors, and partners shall not be liable for:

  • Misuse of products
  • Adverse reactions
  • Consumer misuse
  • Legal violations by purchasers
  • Lost profits
  • Business interruption
  • Indirect or consequential damages

Products are sold “AS IS” and “AS AVAILABLE.”

16. INDEMNIFICATION

You agree to indemnify and hold harmless Hill Country Hemp and Hemp-A-Rita from any claims, damages, liabilities, losses, or expenses arising from:

  • Your misuse of products
  • Your violation of laws
  • Your resale activities
  • Your marketing claims
  • Your breach of these Terms

17. DISPUTE RESOLUTION

Any disputes arising from these Terms, website usage, or purchases shall be resolved exclusively through binding arbitration in the State of Texas.

You waive:

  • Jury trial rights
  • Participation in class actions
  • Consolidated legal proceedings

Texas law governs these Terms.

18. MODIFICATIONS

Hill Country Hemp reserves the right to modify these Terms at any time without prior notice.

Continued use of the websites or continued purchasing constitutes acceptance of updated Terms.
